Terms of Use – Bulk Water Depot

Please read the Terms of Use carefully before you start to use any of our Websites. By using any of our Websites, you accept and agree to be bound and abide by these Terms of Use (herein referred to “Terms’ or “Terms of Use”), incorporated herein by reference. If you do not want to agree to these Terms of Use, you must exit this service and do not use the service or any of its affiliates and subsidiaries.

These Terms apply to the Bulk Water Depot, its affiliates and subsidiaries (hereinafter “BULK WATER DEPOT”)as well as the Bulk Water Depot family of websites, including but not limited to, www.BulkWaterDept.com, www.FillPools.com, and all features on or downloadable from those websites, including but not limited, mobile applications corresponding with Bulk Water Depot websites, content feeds, other syndicated distribution of content, Podcasts, API Content, widgets, the Bulk Water Depot community and other social networking features, our blogs, third party websites or apps, our related websites, or our mobile applications (collectively the "Site").  These Terms also applies to mobile applications corresponding with Bulk Water Depot Websites, content feeds, other syndicated distribution of content, Podcasts, API Content, widgets, the Bulk Water Depot community and other social networking features.

CHANGES TO THESE BULK WATER DEPOT TERMS OF USE

We may revise and update these Terms from time to time in our sole discretion. All changes are effective immediately when we post them, and apply to all access to and use of any Site thereafter. However, any changes to the dispute resolution provisions set forth in Governing Law and Jurisdiction will not apply to any disputes for which the parties have actual notice prior to the date the change is posted on the websites.

Your continued use of any Site following the posting of revised Terms means that you accept and agree to the changes. You are expected to check this page from time to time so you are aware of any changes, as they are binding on you.

ASSUMPTION OF RISK DISCLAIMER

Your use of our Sites at your sole risk. Except as otherwise provided in a writing by us, our Site and any content therein (including any Third-Party Content) are provided “as is” and “as available” without warranties of any kind, either express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. In addition, Bulk Water Depot does not represent or warrant that our Site will be available, accurate, complete, reliable, current or error-free. You assume the entire risk as to the quality and performance of the Site.

ACCESSING THE WEBSITES AND ACCOUNT SECURITY

We have the right to modify, suspend, terminate, delete or cease Bulk Water Depot Sites, content, services, materials and features provided in any way, at any time or for any reason or no reason.  You also have the right to stop using our Sites at any time.  Bulk Water Depot is not responsible for any loss or harm related to your inability to access or use Sites at any time.

We will not be liable if for any reason, all or any part, of the Sites are unavailable at any time or for any period. From time to time, we may restrict access to some parts of the Sites, or the entire Sites, to users, including registered users.

You are responsible for:

* Making all arrangements necessary for you to have access to the Sites.

* Ensuring that all persons who access the Sites through your internet connection are aware of these Terms and comply with them.

To access a Site or some of the resources offered, you may be asked to provide certain registration details or other information. It is a condition of your use of a Site that all the information you provide on the Site is correct, current and complete.  If you provide any information that is untrue, inaccurate, not current or incomplete, or we have reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, we have the right to suspend or terminate your account access and refuse any and all current or future use of any Site (or any portion thereof).  You agree that all information you provide to register with a Website or otherwise, including but not limited to through the use of any interactive features on the Site, is governed by our Privacy Policy, and you consent to all actions we take with respect to your information consistent with our Privacy Policy.

If you choose, or are provided with, a user name, password or any other piece of information in order to access a Site or certain pages of a Site, you must treat such information as confidential, and you must not disclose it to any other person or entity. You also acknowledge that your account is personal to you and agree not to provide any other person with access to this Site or portions of it using your user name, password or other security information. You agree to notify us immediately of any unauthorized access to or use of your user name or password or any other breach of security. You also agree to ensure that you exit from your account at the end of each session. You should use particular caution when accessing your account from a public or shared computer so that others are not able to view or record your password or other personal information.  We will not be liable for any harm related to disclosure of your user name or password or the use by anyone else of your user name or password.

If you register on a Site and/or create a personal profile, you agree to accept responsibility for all activities that occur under your account (“Account”) or password, if any, and you agree you will not sell, transfer or assign your membership or any membership rights (including access) to your Account.  Your Account username may not include the name of another person with the intent to impersonate that person, or be offensive, vulgar or obscene. Furthermore, you are entirely responsible for any and all activities (including purchases) that occur under your Account. You agree to immediately notify us of any unauthorized use of your Account or any other breach of security of which you become aware.  We may require you to change your user name and/or password if we believe your Account is no longer secure or if we receive a complaint that your user name violates someone else's rights. 

You will have no ownership in your Account or your user name. We may refuse registration, cancel an account or deny access to a Site for any reason.

We have the right to refuse registration, cancel an Account, deny access to a Site, or disable any Account, user name, password or other identifier, whether chosen by you or provided by us, at any time if, in our opinion, you have violated any provision of these Terms or for any other reason.

CHANGES TO SITE

We may update the content on a Website from time to time, but the content may not necessarily complete or up-to-date. Any of the material on a Website may be out of date at any given time, and we are under no obligation to update such material.

YOU MAY NOT ACCESS OR USE THIS SITE OR ACCEPT THESE TERMS UNLESS YOU ARE AT LEAST 18 YEARS OLD.  If you are under 18 years of age (or the age of legal majority where you access this Site), you may use our Site only with the permission of a parent or legal guardian who agrees to be bound by these Terms. If you are a parent or legal guardian of a user under the age of 18 (or the age of legal majority where you access this Site), you agree to be fully responsible for the acts or omissions of such user, including any breach of these Terms and for determining the suitability of this Site for such user.

By clicking or tapping “Sign In”, “Members Only”, “Create Account”, “Place Order” or entering or otherwise using the Site, you agree to and accept these Terms that govern your use of the Site (the “Terms of Use” or “Terms”). Certain products, programs and services on our Site (the “Products”) may have additional Terms that apply and are incorporated in these Terms. If these Terms of Use are inconsistent with Terms applicable to a certain product or service, those other Terms will control.

BY ACCESSING AND/OR USING THE SITE, YOU REPRESENT AND WARRANT THAT YOU HAVE THE RIGHT, AUTHORITY, AND CAPACITY TO ENTER INTO THE TERMS AND WILL ABIDE BY ALL APPLICABLE LAWS AS WELL AS ABIDE BY ALL OF THE REQUIREMENTS SET FORTH HEREIN.   

ELECTRONIC COMMUNICATIONS

When you use our Site, or send e-mails, text messages, chat, message boards, use video calling and other communications from your desktop or mobile device to us, you are communicating with us electronically. You consent to receive communications from us electronically, such as e-mails, texts, mobile push notices, or notices and messages on this Site and you can retain copies of these communications for your records. You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing. Where required by applicable law, we will seek express prior written consent for marketing text messages or calls to you.

USER ACCOUNTS

If you register for an account to use our Site, you must provide accurate account information and ensure that you maintain the accuracy of this information at all times. You are fully responsible for all activities that are associated with your Bulk Water Depot Account (including but not limited to any purchases, posting reviews or other use of the Site). You agree to keep your username and password information confidential and not share it with anyone. You also must maintain the security of your account (including by logging out of your account at the end of each session), and promptly notify us if you discover or suspect that someone has accessed your account or your account credentials without your permission. If you permit others to use your account, you are responsible for the activities of those users. We reserve the right to reclaim usernames for any reason, including on behalf of businesses or individuals that hold trademark rights or other legal claims in those usernames.

Bulk Water Depot at any time and for any reason, in its sole discretion and without any liability to you or any third-party, may suspend or terminate your account or use of or access to the Bulk Water Depot family of Sites (or any portion thereof).

COPYRIGHTS

The entire content included in this Site, including but not limited to text, graphics or code is protected and copyrighted as a collective work under the United States and International copyright laws, and is the property of Bulk Water Depot. The collective work includes works that are licensed to Bulk Water Depot, ALL RIGHTS RESERVED. You may display and, subject to any expressly stated restrictions or limitations relating to specific material, download or print portions of the material from the different areas of the site solely for your own non-commercial use.  Any other use, including but not limited to the reproduction, distribution, display or transmission of the content of this Site is strictly prohibited, unless authorized by Bulk Water Depot. You further agree not to change or delete any proprietary notices from materials downloaded from the Site.

The contents of the Bulk Water Depot Sites, including but not limited to, podcasts, content feeds, API Content and other features, are owned by or licensed to us. In the case of User Materials (as defined in the "User Materials" section below) the contents are licensed to the Bulk Water Depot Sites by the user. You may not reproduce, distribute, republish, upload, transmit, display, prepare derivative works, publicly perform, sell, transfer, assign, license or use for commercial purposes,  any copyrighted material on the Bulk Water Depot family of Sites without our prior written consent, except as provided below.  All rights not expressly granted in these Terms are reserved to the Bulk Water Depot Sites.

You may copy, download one copy on a single computer and print a limited amount of content, for your personal, non-commercial use only, provided that {a) you include without modification all copyright and other proprietary notices contained in the content,(b) you do not modify the content,(c) you do not use the content in a manner that suggests we promote or endorse your, or any third parties, causes, ideas, web sites, products or services, and  (d) you do not use the content in any way that is unlawful or harmful to any other person or entity. In addition, you may use widgets and tools on the Bulk Water Depot Sites websites that allow selected User Materials to appear on your personal, non-commercial website, weblog or other application, subject to the conditions in the preceding sentence.

No quotes from any material on the Bulk Water Depot may be used in any media without attribution to us.

You may use the Content Feeds, API Content, Podcasts and other features of the Bulk Water Depot Sites only as expressly permitted in the relevant paragraphs below in these Terms.

Any other use the Bulk Water Depot Sites content requires our prior written permission from Bulk Water Depot.

TRADEMARKS

The Bulk Water Depot name, Bulk Water Depot logos and other related names, logos, product and service names, designs and slogans are of Bulk Water Depot or its affiliates or licensors that have licensed the use of their names and logos to the Service. All rights are reserved by the respective owners. You may not use any of the Sites- provided service marks, logos or graphics, without our prior written consent of Bulk Water Depot, except that you shall have the right and obligation to use the Sites or other service mark or logo included in or required to be used in connection with, API Content, Content Feeds, Media Players or other functionalities of the Sites, subject to the requirements set forth in these Terms of the API content, content feeds or other functionalities of the Sites. 

All other names, logos, product and service names, designs and slogans on our Websites are the trademarks of their respective owners.

TRADEMARKS - PROHIBITED USES

You may use our Sites only for lawful purposes and in accordance with these Terms. You agree not to use the Bulk Water Depot family of Sites:

1. In any way that violates any applicable federal, state, local or international law or regulation (including, without limitation, any laws regarding the export of data or software to and from the US or other countries).

2. For the purpose of exploiting, harming or attempting to exploit or harm minors in any way by exposing them to inappropriate content, asking for personally identifiable information or otherwise.

3. To send, knowingly receive, upload, download, use or re-use any material that does not comply with these Terms of Use.

4. To transmit, or procure the sending of, any advertising or promotional material, including any “junk mail”, “chain letter” or “spam” or any other similar solicitation.

5. To impersonate or attempt to impersonate Bulk Water Depot, a Bulk Water Depot employee, another user or any other person or entity (including, without limitation, by using e-mail addresses or screen names associated with any of the foregoing).

6. To engage in any other conduct that restricts or inhibits anyone’s use or enjoyment of our Sites, or which, as determined by us, may harm Bulk Water Depot or users of our Sites or expose them to liability.

Additionally, you agree not to:

1. Use Bulk Water Depot family of Sites in any manner that could disable, overburden, damage, or impair the Bulk Water Depot family of Sites or interfere with any other party’s use of Bulk Water Depot family of Sites, including their ability to engage in real time activities through the Bulk Water Depot family of Sites.

2. Use any robot, spider or other automatic device, process or means to access the Bulk Water Depot family of Sites for any purpose, including monitoring or copying any of the material on the Bulk Water Depot family of Sites or to cache, frame, mask extract data from, copy or distribute any content or data from the Bulk Water Depot family of Sites.

3. Use any manual process to monitor or copy any of the material on the Bulk Water Depot family of Sites or for any other unauthorized purpose without our prior written consent.

4. Modify, frame, reproduce, archive, sell, lease, rent, exchange, create derivative works from, publish by hard copy or electronic means, publicly perform, display, disseminate, distribute, broadcast, re-transmit, circulate to any third party or on any third-party web site, or otherwise use any content or data from the Bulk Water Depot family of Sites in any way for any public or commercial purpose except as specifically permitted by these Terms or Bulk Water Depot without the prior written consent of Bulk Water Depot.

5. Use any device, software or routine that interferes with the proper working of the Bulk Water Depot family of Sites.

6. Introduce any virus, Trojan horse, worm, logic bomb or other material which is malicious or technologically harmful.

7. Attempt to gain unauthorized access to, interfere with, damage or disrupt any parts of the Bulk Water Depot family of Sites, the server on which the Bulk Water Depot family of Sites is stored, or any server, computer or database connected to the Bulk Water Depot family of Sites.

8. Attack the Bulk Water Depot family of Sites via a denial-of-service attack or a distributed denial-of-service attack.

9. Otherwise attempt to interfere with the proper working of the Bulk Water Depot family of Sites.

STREAMING VIDEO CONTENT AND DIGITAL MEDIA

For any Streaming Content that we make available on Bulk Water Depot family of Sites, we grant you a revocable permission, subject to the restrictions in these Terms and any applicable Additional Terms, to include the Embed Code as provided by us (without editing) for inclusion only on your Personal Page and only on a website that: (i) permits you to post the Streaming Content there; and (ii) does not have terms of use or other conditions that purport to give that site operator any interest or right in or to our Embed Code or Streaming Content other than to obtain a limited, terminable right to host the Streaming Content and permit its normal operation.  You may not frame the Streaming Content nor include any "pre-roll" or "post-roll" video in connection with such Streaming Content.  You may not redistribute or assign any right or title in the Embed Code.  You may not use the Embed Code for commercial purposes.  You agree not to display the Streaming Content in connection with any material or content that is libelous, defamatory, obscene, pornographic, threatening, invasive of privacy or publicity rights, abusive, illegal or otherwise objectionable, or any content or material that would constitute or encourage a criminal offense, violates the rights of any party, or that would otherwise give rise to liability, or violates any law or obligation of confidentiality.  Your use of the Streaming Content may display our trademarks contained in the Steaming Content or Materials made available thereby, but we control the use thereof and all goodwill associated with such use inures exclusively to us. 

As described below, we make no specific warranties about Streaming Content and we may discontinue providing the services necessary for the Streaming Content to operate at any time for any reason without any liability to you. 

In addition, we may disable Streaming Content that you include on your Personal Page(s) if you violate these Terms (as determined by us in our sole discretion), or for any or no reason, without any liability to you.  You agree that our permission to you to use Streaming Content on your Personal Page does not provide you (or any third party) with any intellectual property rights, including copyrights, in or to the Streaming Content or the Materials made available.  You agree not to circumvent (or in any way attempt to circumvent) the security or rights management features in Streaming Content (including any video player) that are designed to prevent users from copying, manipulating or retaining the Streaming Content.

SOFTWARE AND OTHER ITEMS AVAILABLE FOR DOWNLOAD 

Any items that we make available for download or use from the Sites and/or our servers, including, without limitation, the Digital Media Purchases (the “Downloadable Items”) are the copyrighted work of Bulk Water Depot or its licensors or suppliers. You may not use the Downloadable Items for commercial purposes. Your use of the Downloadable Items may be governed by the Terms and Additional Terms, which may be included with the Downloadable Items. 

Please carefully read any Additional Terms to determine the full extent of conditions governing the use of such Downloadable Items.  WITHOUT LIMITING THE FOREGOING, COPYING OR REPRODUCTION OF THE DOWNLOADABLE ITEMS TO ANY OTHER SERVER OR LOCATION FOR FURTHER REPRODUCTION OR REDISTRIBUTION IS EXPRESSLY PROHIBITED, UNLESS SUCH REPRODUCTION OR REDISTRIBUTION IS EXPRESSLY PERMITTED BY THE LICENSE AGREEMENT APPLICABLE TO SUCH DOWNLOADABLE ITEMS.  Note that if you install certain applications that may be available via the Bulk Water Depot family of Sites, you consent to the download of software to your computer and accept these Terms and any Additional Terms related to such application.  The Bulk Water Depot family of Sites may provide updates to the Downloadable Items for feature, security or other enhancements from time to time.  You agree to hold Bulk Water Depot harmless in the event of damage to your device used to access the Bulk Water Depot family of Sites or data that may result from your use of the Downloadable Items.

USER MATERIALS

User Content of the Sites user mean any and all information and content, including photographs, that such user submits to Bulk Water Depot family of Sites, by any means, including social media (e.g. Face Book, YouTube, Insta-gram, Twitter, etc.) uses with the Bulk Water Depot family of Sites (e.g. user profile, product review, question and answer) or when you otherwise interact with Bulk Water Depot (e.g. when you call customer service, send us emails, text messages, messenger via Face Book, etc.).  You are solely responsible for your User Content.  You assume all risks associated with the use of your User Content, including any reliance on its accuracy, completeness or usefulness by others, or any disclosure of your User Content that makes you or any third party identifiable.

Through various portions (links, pages, “Contact Us”, etc.) of our Sites through other features of the Bulk Water Depot Sites, users may have the opportunity to participate in message boards, forums, social networking, blogs, post, upload, display, perform, publish, distribute, broadcast, transmit and/or otherwise submit (“Submit”) comments, messages, other text, photos, images, story ideas, make recommendations, essays, other content/ materials and any other communication to Bulk Water Depot or Sites, including without limitation Designs (defined below), photographs, writings, music, video, audio recordings, computer graphics, pictures, data, questions, comments, suggestions or personally identifiable information (collectively, “User Content”).  You acknowledge that User Materials may be routed through our servers, the servers of one or more third parties on our behalf and the Internet and may be viewed by our staff and on the Internet by the general public. You acknowledge that the Bulk Water Depot family of Sites and other features of the Service are for public and not private communications.

We reserve the right to screen, refuse to post, remove or edit User Materials at any time and for any or no reason in our absolute and sole discretion without prior notice, although we have no duty to do so.  If we elect to screen User Materials, there may be a delay in the posting of such content to allow for a review process.

Except as otherwise described in our posted Privacy Policy, or other agreement on the Sites at which you provide your User Content, you agree that your User Content will be treated as non-confidential and non-proprietary and will not be returned.  You agree that you either: (i) own the rights to the User Content you submit and the right to grant all of the rights and licenses in these Terms; or (ii) you have all necessary rights and licenses from the owner(s) of these rights to enter into these Terms and grant Bulk Water Depot these licenses. 

LICENSE TO BULK WATER DEPOT FOR USER CONTENT

You perpetually and irrevocably grant to Bulk Water Depot the unrestricted, unconditional, non-exclusive, unlimited, worldwide, irrevocable, perpetual and royalty-free right and license to host, use, copy, distribute, reproduce, disclose, sell, re-sell, sub-license, display, perform, transmit, publish, broadcast, modify, reformat, translate, archive, store, cache or otherwise exploit in any manner whatsoever, all or any portion of your User Content for any purpose whatsoever in all formats; on or through any media, software, formula or medium now known or hereafter developed; and with any technology or devices now known or hereafter developed and to advertise, market and promote the same. 

You further agree that Bulk Water Depot is free to use any ideas, concepts, know-how or techniques contained in any User Content you send to the Sites or Bulk Water Depot, for any purposes whatsoever, including, without limitation, developing, manufacturing and marketing products and or services using such User Content; or creating informational articles based on or advertising our products and services, and without compensation of any kind. 

You perpetually and irrevocably grant to Bulk Water Depot the unrestricted, unconditional, right to use and exploit your name, persona and likeness included in any User Content and in connection with any User Content, without any obligation or compensation to you. 

You agree that by submitting User Materials on or through the Bulk Water Depot family of Sites, you hereby grant us and our licensees the right to sub-license and authorize others to exercise any of the rights granted to Bulk Water Depot under these Terms; and each such third party will be entitled to benefit from the rights and licenses granted to Bulk Water Depot under these Terms of Use.  You further authorize Bulk Water Depot to publish your User Content in a searchable format that may be accessed by users of the Sites and the Internet.  Except as prohibited by law, you waive any moral rights you may have in any User Content you submit, even if such User Content is altered or changed in a manner not agreeable to you.

You agree that by submitting User Materials on or through the Bulk Water Depot family of Sites, you hereby grant us and our licensees a non-exclusive, perpetual, royalty-free, worldwide, transferable license to use, copy, sublicense, modify, transmit, publicly perform, display, create derivative works of, host, index, cache, tag, encode and/or adapt your User Materials in any and all media formats or channels, whether now known or hereafter devised, including but not limited to the Bulk Water Depot family of Sites, the Service, third party licensee Sites, over the air (on radio or television) and on mobile platforms, without payment and without further consent or notice to you.  You further grant the Bulk Water Depot family of Sites and their licensees the right to contact you in connection with your User Materials and to use your name, city and state and other information that you had provided in connection with the User Materials.

In addition, you grant each user of the Bulk Water Depot family of Sites a non­ exclusive, royalty-free, worldwide license to access your User Materials on or through the Bulk Water Depot family of Sites, to use your User Materials pursuant to these Terms, and as permitted by the functionality of the Bulk Water Depot family of Sites (such as through widgets and API Content distribution).

You also acknowledge that the Internet may be subject to breaches of security and should be aware that submissions of User Content or other information may not be secure, and you should consider this before submitting any information to Bulk Water Depot.

For any User Materials you submit on or through the Bulk Water Depot family of Sites, you agree to abide by the Terms set forth herein and any the Social Networking Discussion Rules (for User Materials Submitted through the Bulk Water Depot Sites or in response to a Bulk Water Depot blog). You further agree to the representations and warranties, and indemnification obligations, set forth herein.

REPRESENTATIONS; INDEMNITY

You represent and warrant that (a) if you submit any User Materials or personally identifying information on or through the Service, you are at least 18 years of age, (b) you have obtained all clearances, releases, licenses and rights to any User Materials you submit on or through the Service that may be necessary for their use as contemplated by the Bulk Water Depot family of Sites and these Terms,(c) there are no encumbrances or restrictions on the User Materials or their use as contemplated by the Bulk Water Depot family of Sites and these Terms,(d) the User Materials, and their use by the Bulk Water Depot family of Sites, their licensees, and users (pursuant to these Terms) does not and will not defame any person or entity, violate or infringe upon the copyright, trademark, patent, trade secret, privacy, reputation, creative or other rights of any person or entity or violate these Terms or the Social Networking Discussion Rules (for User Materials submitted through the Bulk Water Depot community, and (e) your use of the Service complies with these Terms.

You agree that you will indemnify, defend and hold harmless the Bulk Water Depot and their respective directors, officers, agents, employees, members, licensors and suppliers, licensees from and against any and all losses, damages, claims, liabilities, costs or expenses, including reasonable attorneys’ fees, arising from (1) your breach of any of the above representations and warranties,{2) your use of Service,(3) the User Materials you have submitted on or through the Service, or (4)  the Service’s publication, distribution or use of such User Materials, or the authorized publication, distribution or use of your User Materials by the Service or its licensees and users.

You retain the copyright and other ownership rights in any User Materials that you submit on or through the Bulk Water Depot family of Sites.  However, by submitting User Materials on or through the Bulk Water Depot family of Sites, you hereby grant us and our licensees a non-exclusive, perpetual, royalty-free, worldwide, transferable license to use, copy, sublicense, modify, transmit, publicly perform, display, create derivative works of host, index, cache, tag, encode, and/or adapt your User Materials in any and all media formats or channels, whether now known or hereafter devised, including but not limited to the Bulk Water Depot family of Sites, the Service, third party licensee web sites, over the air (on radio or television) and on mobile platforms, without payment and without further consent or notice to you.  You further grant the Bulk Water Depot family of Sites and their licensees the right to contact you in connection with your User Materials and to use your name, city and state and other information that you have provided in connection with the User Materials.

In addition, you grant each user of the Bulk Water Depot family of Sites a non­ exclusive, royalty-free, worldwide license to access your User Materials on or through the Bulk Water Depot family of Sites, to use your User Materials pursuant to these Terms and as permitted by the functionality of the Bulk Water Depot family of Sites (such as through widgets and API Content distribution).

FRAMING LINKS TO BULK WATER DEPOT SITES

We encourage and permit links to content on the Bulk Water Depot family of Sites. There is no fee for accessing any of our Bulk Water Depot family of Sites to vie free content including the content of third parties that we display.  You may browse our Bulk Water Depot family of Sites without registering for an account. You will be required to register for an Account to use certain features of the Bulk Water Depot family of Sites. 

YOU ASSUME ALL RISKS AND DANGER of property damage, personal injury, death, and all other hazards related in any way to attending any Bulk Water Depot Event, anywhere at the facility and at all times before, during or after the events. Dangers include flying objects, vehicles, other people, conditions at the facility, and unforeseen hazards. You agree that Bulk Water Depot, facility owners and operators, participants and each of their respective officers, owners, officials, sponsors, contractors, employees and agents shall not be liable for any loss, damage, or injury to you and you hereby release them from all claims for liability arising from your attendance at or participation in any Bulk Water Depot Event.  Be alert for hazards at all times.

You consent to reasonable searches at Bulk Water Depot Events and Event premises for alcohol, drugs or other prohibited items.

RECORDINGS AT BULK WATER DEPOT EVENTS

Bulk Water Depot, its assignees or permittees may record, use, reproduce, exhibit and publicly display your voice, image or likeness in any live or recorded video or audio recording, display, photograph, or other transmission, image or reproduction of all or part of any Event, and in any programs, videos, audio recordings, publications, advertisements or promotional materials, in all media, anywhere, forever.

RECORDINGS BY YOU. 

YOU CAN TAKE PHOTOGRAPHS OR MAKE AUDIOVISUAL RECORDINGS OR IMAGES AT BULK WATER DEPOT EVENTS AND ON EVENT PREMISES ONLY FOR YOUR PRIVATE USE.  Bulk Water Depot and/ or Facilities owns all Events and all sights, sounds, occurrences, results and statistics, copyrights, trademarks, rights of publicity and other proprietary rights related to each Event (the “Bulk Water Depot Content”). 

Bulk Water Depot and/ or Facilities are the exclusive owner of all rights to publicize, transmit in any way, whether to the public or not, and exploit, whether commercially or not, the Bulk Water Depot Content.  Therefore, you will not record or transmit any Bulk Water Depot Content (including content recorded or photographed by you) other than for your private, non-public use.  You will not directly or indirectly through third parties sell, offer to sell, post, distribute, disseminate, publish, display, exhibit, broadcast, rebroadcast, upload, or stream any of Bulk Water Depot Content by any means whatsoever such as the internet, radio, television, mobile device,, data accessory, live streaming or transmission technology, or any other media, social media, film, video recording, photographic image(s), webcast or broadcast (delayed or live), or digital recording.  If you violate this license by posting, distributing or publicly performing any Bulk Water Depot Content to, for example, YouTube or any other Internet, social media, mobile or other site, even a personal site with limited access, you agree to take down and grant consent for Bulk Water Depot to have taken down any such Bulk Water Depot Content upon Bulk Water Depot’s request to you or any third-party (such as the relevant online service provider).
